Mr. Sudipta Ghosh Mr. A.K. Datta .... For the State. The petitioners claim to be students. They are the son and daughter of the principal accused in the ponzi scam. Learned counsel for the State submits that they were actively involved in collection of money.

This is denied on behalf of the petitioners claiming that they are students without having any connection with the ponzi scam. The petitioners were arrested on 18th April, 2022 and are in custody for 207 days. Investigation is complete and chargesheet has been submitted.

Admittedly two co-accused, not related to the principal accused have been enlarged on bail by this court. Considering the facts and circumstances above, we are of the view that the petitioners should now be enlarged on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional District Judge,3rd Court, Alipur, subject to the following conditions:-

1. The petitioners are to deposit their passport, if they have one, with the investigating agency within three days from date;

2. They will meet the investigating officer as and when summoned

3. They will not leave the municipal limits of Kolkata without informing the investigating officer.

4. They will not tamper with evidence or interfere with the witnesses in any manner.

5. The petitioners shall attend the court on each and every day of trial, in default, the court shall be at liberty to cancel the bail bond without any reference to this bench. (Biswaroop Chowdhury J.) (I.P. Mukerji, J.)
