1. This Revisional Application (CRR 4137 of 2025) has been moved by Learned Counsel for the Petitioner, challenging the order dated 3rd March, 2025, passed in Complaint Case No. 99 of 2023 pending before the Learned Additional Chief Judicial Magistrate (ACJM), Basirhat, North 24-Parganas.

2. The said Complaint Case was filed under Section 12 read with Sections 8, 19, 20, 22, and 23 of the Protection of Women from Domestic Violence Act, 2005, and the impugned order directed the issuance of a Warrant of Arrest against the Petitioner, fixing 22nd September, 2025, for the filing of the execution report.

3. Learned Counsel for the Petitioner submits that the Petitioner is ready and willing to pay the outstanding

amount of Rs. 55,700/- to the Opposite Party No. 2 (O.P. No. 2/wife).

Conditional Interim Stay

4. Considering the Petitioner's submission and his readiness to liquidate the outstanding amount, the execution of the Warrant of Arrest issued by the impugned order dated 3rd March, 2025, is hereby STAYED till 4th November, 2025.

5. This interim order is granted subject to the following strict conditions:

a. The Petitioner is Directed to pay the entire outstanding amount of Rs. 55,700/- to O.P. No. 2/wife.

b. The Petitioner shall file a proper receipt of payment with the Learned Executing Court, Learned ACJM, 1st Court, Basirhat, North 24-Parganas.

6. The Learned Executing Court shall proceed to pass necessary orders as per law after the submission of the proper receipt of payment.

7. It is made clear that in the event the Petitioner fails to comply with these conditions, the interim order for stay of the operation of the Warrant of Arrest shall stand

automatically vacated without further reference to this Court.

8. The Petitioner shall remain at liberty to take appropriate steps before the Learned Executing Court.

9. CRR 4137 of 2025 stands disposed of accordingly. (Uday Kumar, J.)
