The petitioner is aggrieved by the order dated 14th November, passed by the learned Judicial Magistrate, 1st Court, Alipore in connection with Case No. M/44 2012.

By the order impugned the learned Magistrate has dismissed the application for default since the petitioner/complainant was absent before the learned Court for a long time and did not respond to the show cause issued against her.

The petitioner seeks to withdraw the application and take necessary steps before the learned Magistrate. If the petitioner files appropriate application before the learned Magistrate within a fortnight from date, learned Magistrate shall deal with the application on merits and not dismiss the same on the ground of limitation.

Further liberty is granted to withdraw the certified copies of the documents filed before this Court upon furnishing photocopies thereof.

In view of the above, CRR 3825 of 2024 is dismissed as withdrawn.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
