Affidavit-of-service filed in Court today, is taken on record.

The writ petition is premature. The petitioners' allegation that the authorities were measuring their land in order to install a high tension line, is unfounded.

The authority submits that on account of a representation received from the villagers, an inspection was made of the locality, to ascertain the location where a new transformer could be installed. The authorities did not plan to install such transformer on the land of the petitioners.

The police authorities have also filed a report. The report is taken on record. It appears that a preliminary enquiry was made by Sub-Inspector, Pranab Kumar Saha. A joint meeting was arranged and the petitioners were also asked to appear in the said meeting.

In any event, as the authority does not have any plan to utilize the petitioners' land, the question of referring the matter to the District Magistrate for a decision, does not arise. The authority shall act on the basis of such submission and in accordance with law.

Accordingly, the writ petition is disposed of. 7.

However, there will be no order as to costs.
