Mr. Sourav Bose ...for the petitioners Liberty is given to the learned advocate for the petitioners to correct the body of the petition at page one.

A direction to secure expeditious disposal of a probate proceeding being OS/62/2010 pending before the learned Additional District Judge, 13th Bench, at Alipore, South 24 Parganas, is the ultimate relief sought for in this case.

The only contention expressed by the petitioners is against the delay caused in the disposal of the probate proceeding for the adjournment being granted on the prayer of the opposite parties.

No other point is raised requiring address by this Court.

Admittedly, the case is appearing at the state of evidence.

In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary.

Service upon the opposite parties stands dispensed with.

Accordingly, learned Additional District Judge, 13th Bench, Alipore, South 24 Parganas, is directed to ensure expeditious disposal of the case being OS/62/2010, subject to the suitability and convenience of the court below after causing disposal of interlocutory application, if there be any pending, providing sufficient opportunity of hearing to either of the parties to this case, but without granting any unnecessary adjournment, unless it is extremely unavoidable, preferably before the end of Puja Vacation of the court below for the year, 2023.

With this observation/direction, the revisional application stands disposed of.

Parties are directed to make communication of this order to the court below.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
