The petitioner complains of illegal and unauthorised construction at 87, Becharam Chatterjee Road, Ward No. 130, Borough - XIV, Kolkata 700034. Learned advocate representing the private respondent nos. 4 and 5 produces copy of the order 3rd March, 2023 passed by the Special Officer (Building), in respect of the selfsame premises.

It appears that the authority of the Kolkata Municipal Corporation has taken steps in response to the complaint lodged by the petitioner and initiated proceeding under Section 400 (1) of the KMC Act, 1980 vide demolition case No. 029-D/Br.-XIV/22-23 and passed necessary order therein.

In view of the above, there is no requirement of proceeding with the writ petition any further. The competent authority of the KMC shall take steps to dispose of the complaint filed by the petitioner, in

accordance with the law, at the earliest.

Copy of the order passed by the Special Officer (Building) be retained with the records.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
