Petitioner is directed to serve a copy of the revisional application upon Mr. Arijit Ganguly, learned Advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. Learned Advocate for the petitioner submits that the petitioner is in custody since 3rd of August, 2022 and after filing of the charge-sheet the court is here to frame charges. The date for framing of charge has been fixed on 3rd of October, 2023. Learned Advocate submits that there are 27 witnesses relied upon by the prosecution to prove his case.

Having considered the series of the huge number of witnesses which the prosecution intends to rely upon to prove its case and the fact that the petitioner is in custody for about 13 months, I direct the learned Special Court to fix the schedule consisting of three dates and fix the schedule in every 60 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

In case any witnesses is reluctant to appear before the Court

the learned Special Court would communicate with the S.P. of the concerned District and the S.P. would take steps for ensuring the appearance of the witnesses concerned.

No unnecessary adjournments be granted to any of the parties. The Public Prosecutor conducting the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses. All stakeholders would cooperate with the learned Trial Court to conclude the trial at the earliest.

With the aforesaid observations, the present revisional application being CRR 3441 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
