The petitioner alleges that no steps have been taken by the police authority in spite of the fact that a complaint has been lodged by the petitioner by a letter dated 06.06.2024.
Affidavit of service filed in Court today is taken on record.
Learned Advocate for the petitioner submits that the respondents have been duly served.
However, none appears for the respondents.
Mr. Suman Sengupta, learned Advocate who usually appears for the State is present in Court and is requested to appear in this matter.
The appointment of Mr. Sengupta and a junior of his choice be regularized by the Legal Remembrancer.
Since the petitioner has lodged a complaint, it is the duty of the police authority to take action in accordance with law.
If the complaint discloses a cognizable offence the Inspector-in-Charge, Kaliachak P.S. shall register an FIR, if not already registered, in accordance with law.
If the said respondent is of the opinion that registration of FIR is not necessary, reasons therefor should be communicated to the petitioner within a period of two weeks from the date of receipt of a server copy of this order.
The petitioner is directed to serve a copy of the application upon Mr. Sengupta in course of this day.
With the above observation and direction this writ petition stands disposed of.
There will be no order as to costs.
Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities (HIRANMAY BHATTACHARYYA, J.)
