The petitioner has challenged the proceedings of C.N. case no. 34311 of 2017 pending before the ld. Metropolitan Magistrate, 10th Court, Calcutta. It has been informed on behalf of the private opposite party that the case is at the stage of 313 of the cr.p.c. before the ld. Trial court. The same is not disputed by the ld. Advocate for the petitioner.

Having considered the stage at which the revisional application is being considered by this court, I am of the view that the case is mature for being taken to its logical conclusion and the inherent power at this stage cannot be invoked to scuttle the proceedings.

However, the petitioner is directed to canvass all the points in the revisional application at the stage of final argument of the case.

The ld. Magistrate would independently deal with the issues without being influenced by any of the observations made by this court.

With the aforesaid observations, CRR 3651 of 2022 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
