Despite service, none appears on behalf of the private respondents.

The limited grievance of the petitioner is that despite having held an inspection and being satisfied that a new electricity connection could be given to the petitioner as per the petitioner's application, the West Bengal State Electricity Distribution Company Limited (WBSEDCL) is not being able to give such connection due to the obstruction raised by the private respondents.

It transpires upon hearing learned counsel for the parties that the WBSEDCL has no objection to give electricity connection to the petitioner at the petitioner's premises over a common passage running beside a pond adjacent to the premises.

It is submitted by learned counsel for the WBSEDCL that the connection, if given over the said passage, would apparently not hamper the possession of any other person.

As the private respondents have chosen not to be represented today when the matter is called on for hearing, the matter is taken up for passing orders ex parte in the absence of the private respondents.

WPA No. 22152 of 2022 is disposed of by directing the WBSEDCL to give new electricity connection to the petitioner, subject to compliance of all formalities by the petitioner, as expeditiously as possible, preferably within four weeks from date.

In the event any resistance or obstruction is created by the private respondents and/or their men and agents, it will be open to the WBSEDCL personnel to approach the respondent no. 6, that is, the Officer-in-Charge of the Budge Budge

Police Station to provide adequate police assistance in such regard.

If so approached, the respondent no. 6 shall act on the written communication of the learned Advocate for the petitioner, coupled with a server copy of this order, without insisting upon prior production of a certified copy thereof, and give such police help at the cost of the petitioners to the WBSEDCL personnel for giving such connection.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
