Selim Sk.

versus The State of West Bengal & Ors.

Ms. Tapati Saha ... For the Petitioner.

Mr. Ashim Kumar Ganguly, Mr. Bellal Sheikh, Mr. Protim Chakraborty ... For the State.

Learned advocate appearing for the State has submitted a status report dated 02.08.2024 prepared by the Officer of Missing Persons Bureau, Criminal Investigation Department, West Bengal. Let the same be kept with the record.

The said report reflects that exhaustive steps have been taken for locating the missing person which is the point of grievance of the petitioner and for which the jurisdiction of this Court under Article 226 of the Constitution of India was invoked. For the last eight years efforts are being taken both by Suti Police Station and Katwa GRPS as well as the criminal investigation department. Number of reports have been submitted before this Court. Having taken into account that the brother of the petitioner is missing since 11.06.2016 and more than eight years the police authorities have put in efforts to trace out the missing person, I am of the view that further pendency of the writ petition is unwarranted. However, the police authorities would carry out their efforts and communicate the

outcome in every six months to the family of the petitioner.

With the aforesaid observations, the writ petition being WPA 20336 of 2016 is disposed of. Pending connected application, if any, is consequently disposed of.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
