Petitioner(s) Mr. Supratic Ray Mr. Shuvjit Ray ... for the Petitioner(s) Mr. Iqbal Kabir Mr. Santanu Talukdar ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is 72-year-old and is in custody since April, 2023. According to the learned advocate, more than two and half years have passed and, till date, the prosecution has failed to conclude the examination of the witnesses, as such, bail has been prayed for.

Learned advocate for the State, on the other hand, submits that the prosecution intends to examine 15 witnesses and out of the 15 witnesses, nine witnesses have been examined and six witnesses are left. Next dates have been fixed by the trial court, are on 20th November, 2025 and 21st November, 2025 for evidence of the three witnesses.

Considering the submissions advanced by both the parties, the trial court is directed to conclude the prosecution's evidence preferably within first week of January, 2026 and the trial of the case would continue inspite of any resolution of the local bar, no unnecessary adjournment be granted to any of the parties. In case, the prosecution is unable to conclude its evidence by the first week of January, 2026 after full cooperation being extended by the accused, the learned trial court would, on an application filed by the accused, release the petitioner on bail after 15th January, 2026. With the aforesaid observations, CRM(M) 1769 of 2025 disposed of.
