A report has been filed by the Chairman of the Municipality dated April 17, 2023 wherefrom it appears that the Municipality has removed the debris of the construction work from the area after demolition with the co-operation of the police personnel.

The petitioner submits that though the debris has been removed but the drains have remained blocked with the construction waste materials.

The petitioner has drawn the attention of the Court to a poster which has been affixed in the area by naming the petitioner and her daughter and affixing the photograph of her daughter. The person who has affixed the photograph or the name of the person who published the poster is not mentioned.

It appears that the persons who were responsible for making the unauthorized construction, out of vengeance has published the poster with the photograph of the petitioner's daughter. The said act cannot be accepted at all and is highly deprecated.

The Officer-in-Charge, Magra Police Station is directed to take note of the matter and take prompt necessary steps against any person/persons who is/are involved with the incident of putting up such poster and to ensure that the petitioner is not harassed in any manner whatsoever.

The Municipality is directed to take steps to clean the drain and ensure that there is no blockage of sewerage water.

The writ petition stands disposed of, however, giving liberty to the petitioner to mention the same, in case the petitioner faces any difficulty at the hands of the persons responsible for making unauthorized construction.

Photograph of the poster which is doing the rounds be retained with the records.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
