Though the petitioners have approached this Court for quashing of a proceeding being Deganga P.S. Case No.275 of 2014 corresponding to G. R. Case No.2459 of 2014 under Section 363/366A/120B of the Indian Penal Code, it is submitted by the learned advocate for the petitioners that warrant of arrest has been issued by the trial Court against the petitioners. The
petitioners undertake to surrender before the trial Court within three weeks from the date and in the meantime, execution of warrant of arrest may be kept in abeyance.
I have heard the learned advocate for the petitioner. The fact remains that the petitioner No.1 had love affairs with the daughter of opposite party No.2 who belongs to another religion. The daughter of the opposite party No.2 converted into Hinduism prior to her marriage and then married to the petitioner No.1. They are now staying happily and in the said wedlock the wife of the petitioner No.1 gave birth to a male child.
Attention is drawn to the learned trial Judge about the fact of the case and the learned trial Judge is requested to take lenient view with regard to bail if the petitioners surrender before him in compliance with the instant order. The revisional application is, thus, disposed of. The petitioners are at liberty to act on the server copy of the order.
