Learned counsel for the petitioner contends that the petitioner seeks to shift his shallow tube-well from the property where it is situated at present to his own portion. However, the West Bengal State Electricity Distribution Company Limited (WBSEDCL) is not cooperating in such endeavour of the petitioner.

Learned counsel for the WBSEDCL submits that no proper application has been made by the petitioner to shift the electricity connection from its present location to some other premises. Moreover, previously there was a bar, since the area was mentioned as a critical

zone, for which a SWID certificate was required. However, at present the said situation has changed, since the area is no longer designated as a critical zone and, as such, no such certificate is necessary.

Learned counsel for the private respondents submits that the private respondents, in principle, have no objection if the petitioner takes electricity connection at his own premises.

Upon hearing learned counsel for the parties, it transpires that at present there is no proper application pending at the behest of the petitioner for shifting of electricity connection. Hence, WPA No. 22180 of 2022 is disposed of by granting liberty to the petitioner to file a proper application in appropriate format before the WBSEDCL for shifting of his electricity connection to his own premises.

If such an application is filed, the same will be processed and the shifting duly done, subject to compliance of all formalities by the petitioner, within a reasonable period by the WBSEDCL.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the

parties upon compliance with the requisite formalities.
