The petitioner applied for counter signature of the permit by the State Transport Authority, West Bengal which was received by the authority on 05.07.2022 despite which the said counter signature has not been done within the period of time mandated by the notification issued by the Government of West Bengal, Transport Department on 22.02.2016.

In producing a copy of letter issued by the RTO and Ex-Officio Assistant Director, State Transport Authority, West Bengal to the Taxing Officer, PVD on this day i.e. 09.11.2022, learned counsel appearing for the respondents submits that such counter signature shall be made in favour of the petitioner upon the petitioner depositing the additional tax and road tax in respect of his permit before the Taxing Officer, PVD.

The petitioner is agreeable to deposit the additional tax and road tax as assessed by the Taxing Officer within 7 days from date.

In view of the above, the writ petition is disposed of with liberty to the petitioner to approach the Taxing Officer, PVD and deposit the additional tax and road tax assessed by the said authority within 7 days from date. Upon the petitioner depositing the said taxes the 4th respondent is directed to make counter signature in the permit of the petitioner as prayed for by the petitioner within 7 days thereafter.

With the above observations and directions this writ petition is disposed of.

There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
