The appellants are aggrieved by order dated September 1, 2023 passed by the learned 6th Bench of the City Civil Court at Calcutta in Title Suit No. 1683 of 203. By the impugned order, the learned Court below refused to grant injunction udner Order 39 Rules 1 and 2 read with Section 151 of the CPC in respect of an election to be held of the Travel Agents Association of Bengal. The election was fixed to be held on September 4, 2023.

This Court is of the view that since the election is over, the application for injunction has become infructuous.

In respect of any other omission and/or commission in the election process, the appellants may approach the Court below with a supplementary affidavit and/or a fresh application as may be advised in accordance with law.

With the aforesaid observations, FMAT 405 of 2023 and CAN 1 of 2023 shall stand disposed of. 5.

There shall be no order as to costs.
