1. Heard the learned advocates for the parties.

2. Petitioner is in custody over a year. He submits he has been falsely implicated in the instant case. He prays for bail.

3. Learned counsel appearing for the State opposes his bail prayer.

4. We have considered the materials on record. Statements of witnesses and seizure memorandum shows recovery over 62 kgs. ganja was recovered from the petitioner and co-accused. Date has been fixed for recording evidence.

5. Under such circumstances, and in view of statutory restrictions under Section 37 of the N.D.P.S. Act, we are not inclined to grant bail to the petitioner at this stage. However, we request the learned Trial Court to expedite the trial and conclude the same at an early date. Parties shall co-operate with the trial in the meantime.
