Mr. Sarajit Sen, Mr. Mrinal Kanti Sardar, Mr. Haradhan Ghosh ... for the petitioner Mr. Srijan Nayak, Mr. Rituparna Maitra ... for the State Petitioner is a Panchayat Karmi under Bhagwanpur Gram Panchayat, Bhangore - II Block, Kolkata. By a general transfer order dated August 29, 2024 he has been transferred to Pathar Pratima Block under Ramganga Gram Panchayat along with 243 other panchayat karmis.

The petitioner submits before this Court that he has an ailing father and a daughter who will be appearing for her Higher Secondary examination in the month of February this year.

It has been further submitted that it takes about eight hours for a to and fro journey from his residence to his new place of transfer.

The petitioner submits that there are number of posts lying vacant at Champahati, Belegachi and Brindakhali Gram Panchayet under Baruipur Block

and the petitioner prays for a modification of his transfer order by transferring him to any of those Gram Panchayats.

In view of the aforesaid fact, I grant liberty to the petitioner to make a fresh representation before the District Magistrate, South 24 Parganas within a period of three days from date praying a modification of his transfer order.

The District Magistrate, South 24 Parganas shall consider the representation within a period of two weeks thereafter.

Till such prayer of the petitioner is considered by the District Magistrate, South 24-Parganas or any other competent authority, the transferring order dated August 29, 2024 as it pertains to the petitioner shall remain stayed.

Accordingly, WPA 22423 of 2024 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
