Case No.513 of 2025 dated 04.07.2025 under Sections 85/109/115(2)/3(5) of the BNS, 2023. And In the matter of:
Janat Sekh and another ... petitioners Ms. Karabi Roy ... for the petitioners Ms. Sujata Das Mr. Rahul Ganguly ... for the State Report filed by the State is taken on record. Copy of further statement of the victim as recorded by the investigating officer is also taken on record. Learned counsel for the petitioners submits that the petitioners are the parents-in-law of the alleged victim. The marriage between the couple took place on 30.12.2022. The wife gave "Talak" to the husband on 27.07.2024. Thereafter, she allegedly conjured up the present facts and lodged a false FIR. The Sessions Court granted anticipatory bail to the husband and the sister-in-law while the prayer for anticipatory bail of the parents-in-law was rejected. Learned counsel for the State opposes the prayer for anticipatory bail and submits that as per the prosecution version, while the mother-in-law and the sister-in-law caught hold of the legs of the victim, the husband and the petitioner
No.1/ the father-in-law attempted to hang her. After torturing the wife, she was driven out with her minor child. There is an injury report and there are statements of neighbours as witnesses to the torture.
Considering the incriminating materials available in the case diary and the alleged roles ascribed to the petitioners, while I am inclined to grant anticipatory bail to the petitioner No.2, the application for anticipatory bail of the petitioner No.1 (Janat Sekh) is rejected.
In the event of arrest, the petitioner No.2 (Jahanara Bibi) shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner No.2 shall cooperate with the investigation and shall not threaten or intimidate witnesses.
The application for anticipatory bail is, thus, disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
