The gram panchayat has found illegal construction, upon hearing the parties. The matter has now been remitted to the Sub-Divisional Officer for further orders in terms of Section 23(5) of the West Bengal Panchayat Act, 1973. Under such circumstances, nothing remains to be decided in this contempt application.

Needless to mention, the Sub-Divisional Officer shall act and proceed in accordance with law within a reasonable time.

Accordingly, the contempt application is disposed of. Contempt proceedings are dropped.

Parties are to act on the basis of the server copy of this order.
