1. This application has been made to add the Registrar of Co-operative Society, as a party respondent, in the instant proceeding. The Registrar, being a necessary and proper party, be added as respondent no. 7 in the instant proceeding.

2. Office is directed to add such Registrar as respondent no. 7 in the cause title of the writ petition.

3. The application is, accordingly, disposed of.

In Re : WPA 21981 of 2025

1. Let affidavit-of-service, as filed in Court, be kept on record.

2. The petitioner is aggrieved by the acts of commission and/or omission of the respondent no. 6, the Co-operative Society.

3. In spite of service, none appears on behalf of the Co-operative Society.

4. The Co-operative Society, according to the petitioner, has not permitted her to join the service, in which she had been engaged and has performed her duties in an unblemished manner since 2011.

5. Mr. Chatterjee, learned Advocate appearing for the petitioner, submits that there is no disciplinary proceeding initiated or pending against the petitioner. In spite of representations made by the petitioner, which have been ignored, the petitioner is not being permitted to join her duty. In the circumstances as aforestated, the petitioner ought to be reinstated in service.

6. Mr. Roy, learned senior Advocate appearing for the added respondent no. 7/Registrar, submits that this being a private dispute, the petitioner is entitled to invoke the jurisdiction of the concerned Registrar under Section 102 of the

West Bengal Co-operative Societies Act, 2006, (hereinafter referred to as the "said Act").

7. Since there is no disciplinary proceeding pending against the petitioner, the petitioner is at liberty to proceed under Section 102 of the said Act and file necessary dispute case to be considered by the concerned Registrar.

8. The concerned Registrar and/or authority is directed to dispose of the dispute case, if filed by the petitioner, within a period of six months from the date of filing the proceeding.

9. With the aforestated directions, the writ petition is disposed of.

10. There shall, however, be no order as to costs.

11. Since no affidavit has been called for, the allegations contained in the writ petition are deemed to be denied.

12.Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
