This revisional application has been filed by the plaintiff/petitioner praying for expeditious disposal of Title Suit No.683 of 2010 along with the interlocutory application, which is pending before the learned Civil Judge (Junior Division), 1st Court at Barasat, District - 24 Parganas (North).

It is submitted that written statement as also the written objection to the application under Order 39, Rule 7 of the Code of Civil Procedure has been filed by the opposite parties.

Under such circumstances, this revisional application is disposed of with a direction upon the learned court below to dispose of the title suit along with the pending application expeditiously keeping in mind the age of the suit. It is directed that the application be disposed of within a month from the next date fixed upon giving an opportunity to the opposite parties to contest the same. Upon disposal of the interlocutory application, the learned

court below shall dispose of the title suit within a year thereafter.

This Court has not gone into the merits of the claim and counter-claim of the parties and the learned court below shall proceed independently and in accordance with law. The petitioner is directed to serve a copy of this revisional application along with a server copy of this order upon the 0pposite parties and/or their learned advocate appearing in the learned court below immediately. The revisional application is disposed of.

However, there will be no order as to costs.
