In terms of the previous order dated 13th September, 2024 matter is taken up for consideration in presence of the learned advocates representing the petitioner, School Authority of Bagnan High School, District-Howrah and the West Bengal Board of Secondary Education.

Ms. Bhattacharyya, learned advocate representing the Board has submitted that decision has been taken by the concerned authority of the Board to relax the conditions for registration of son of the petitioner in order to permit the student to participate in Madhyamik Examination, 2025.

It is further submitted that student did not have requisite percentage of attendance in the

school during his studies in Classes IX & X and same can only be relaxed upon payment of requisite fees.

It is also submitted that student is required to submit filled in form through the authority of Bagnan High School immediately for allotting registration number. It is further submitted that though opportunity was granted to the student and his guardian to take steps but no necessary steps have been taken in the meantime.

However, it is submitted on behalf of the Board that if direction is given by this Court on completion of formalities and depositing requisite fees registration process shall be completed at the earliest.

Having considered the submissions made on behalf of the Board this Court directs the petitioner and his son and the headmaster of Bagnan High School to appear before the Secretary of the Board on 12th November, 2024 at 12 Noon when the petitioner shall deposit requisite fees and filled in form with the assistance of the Headmaster of the school and on receipt of form and fees Board shall take necessary steps for allotting registration number within 48 hours thereafter.

However, it is made clear that for

completing the registration petitioner is required to put in requisite fees including late process fee of Rs.5,000/-.

It is further submitted on behalf of the school authority that Test Examination is going to commence on and from 20th November, 2024. If registration process is completed in terms of this order by the Board, son of the petitioner shall be permitted to participate in Test Examination. With the aforesaid direction, the writ petition stands disposed of.

However, there shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
