Petitioners claim that their cultivation is being interfered with by the private respondents. Learned advocate appearing for the private respondents, on the other hand, submits that they are in possession and there is a civil suit pending inter se between the parties.

State has submitted that already proceedings have been drawn up under Section 126 BNSS.

Having considered that nature of dispute is already before the civil court, if there is any breach of any order of the civil court, petitioners be well advised to approach the civil court.

So far as the State is concerned, I direct the police authorities to ensure that there is no violation of law and order and/or any breach of the peace in respect of the issues pertaining to the land. Police authorities would take steps in respect of violation of any law and order.

With the aforesaid observations, the writ petition being WPA 21998 of 2025 is disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
