Learned advocate for the State has submitted a report. Let the same be kept with the record.

The report reflects that the police authorities have complied with the directions(s) passed by the learned Executive Magistrate, which was initiated under Section 163(2) of the BNSS.

The Officer-in-charge of Belgharia Police Station, in his report, submitted that

the report so called for by the learned Executive Magistrate, would be submitted by 25th of October, 2024.

I have considered the contentions advanced in the writ petition, which relates to the dispute in respect of a property, and I find that the jurisdictional civil court is the appropriate forum for adjudicating the issues which have been canvassed in the writ petition.

As the petitioner has already approached the learned Executive Magistrate under Section 126 and under Section 163 of the BNSS, I direct that the police authorities will ensure that no breach of peace and tranquility takes place at the locale and also strict vigil be kept in the area concerned.

With the aforesaid observations, WPA 22472 of 2024 is disposed of.
