In terms of the order dated 26th September, 2023, the West Bengal Power Development Corporation Limited has filed a written instructions addressed to their advocates dated 9th October, 2023.

It appears that there was a mistake and/or misreading of the regulation B(c) of the WBPDCL Death-Cum-Retiral Benefit, 1992. The reduction in family pension occurred as a consequence of such misreading and misinterpretation.

At paragraph 4 of the instructions, it is stated that the quantum of family pension being paid to the petitioner is being revisited. The issue of entitlement to the dearness allowance and medical allowance will be considered afresh.

Let the instructions be kept with the record. copy of the instructions be given to the learned advocate for the petitioner.

It is expected that the review as proposed by the WBPDCL is completed within a period of one month from date. All arrears payable to the petitioner shall be released including revised pension within the same period.

The aforesaid directions are peremptory.

The writ petition is disposed of.

8.

There will be no order as to costs.

9.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
