Case No.222 of 2023 dated 13.07.2023 under Sections 341/448/323/307/427/ 506/34 of the Indian Penal Code corresponding to G.R. Case No.1616 of 2023.

1. Heard learned advocates for the parties.

2. It is submitted that the incident as involved in the instant case arises out of a case and counter-case.

3. From the injury report of the five victims as available in the CD, we find that the injuries of the victim are not so much serious and those are also not on their respective vital parts of their bodies.

4. Investigation has been completed in the meantime and charge-sheet has been filed.

5. Regard being had to such facts and submissions, factum of permanent residence of the petitioner, nature of allegation, nature of injury as discussed supra, and completion of investigation, it is directed that the

petitioner shall surrender before the learned ACJM, Serampore, Hooghly in the G.R. Case No.1616 of 2023 arising out of the aforesaid P.S. case within 15 days from today. On his surrender and application for bail, he shall be released on bail by the aforesaid Court on such terms and conditions as deemed just and proper in the facts and circumstances of the case.

6. Accordingly, the prayer for the anticipatory bail is allowed.

7. The application being CRM(A) 4025 of 2023 is disposed of.
