And In the matter of : Milan Mal - Petitioner.
Mr. Benajir Hasna, Mr. Aliul Islam, Mr. Sadid Haider ....For the Petitioner.
Mr. Partha Pratim Das, Mr. Shasanka Sekhar ... For the State.
1.
Heard the submissions of both the learned Advocates. 2.
The present petitioner is the principal accused being the husband who assaulted the victim lady as a result she succumbed to her injuries.
3.
Perused the statement made by the witnesses and the daughter under Section 164 Cr.P.C./Section 182 of the BNSS which clearly reveals the role played by the present petitioner. The other co-accused, not similarly circumstanced, were enlarged on bail. The charge has not yet been framed, though the chargesheet was submitted in the year 2024. At this stage, this Court does not find it proper to allow the prayer for bail of the petitioner.
4.
Accordingly, the prayer for bail stands rejected.
5.
However, the learned trial Court is directed to take all necessary steps so that the charge is framed at an earliest. 6.
