The learned Advocate representing the petitioner submitted to have filed an application being CAN 1 of 2024 which, inter alia, stated the earlier Advocate on record could not attend the Court on 26th April, 2024 due to her illness and the instant writ petition was dismissed for default by an order dated 26.04.2024 passed by the Co-ordinate Bench of this Court.

Considering the averment in Paragraphs 2, 3, 4 and 5 in the instant application, let the order dated 26.04.2024 be recalled. The instant writ petition be restored to its original file and number. Accordingly, CAN 1 of 2024 is disposed of.

In re: WPA 18438 of 2010 The learned Advocate on record representing the respondent/Bank, according to the version of his junior

being engaged in a different Court, could not appear before this Court.

The learned Advocate representing the petitioner submitted that pleadings are completed and the writ petition is ready for hearing.

Next date be fixed on 9th December, 2025.
