Sarwar Jahan Mr. Nayeemul Hoque ...for Respondent No.7 Pursuant to the order dated 10th December, 2024, a report in the form of affidavit affirmed on 20th December, 2024 by the respondent no.7 is filed today and same is taken on record.

The learned advocate representing Panchagram I.S.A. High School, Murshidabad on instruction submits that at the time of affirming the report there were five Assistant Teachers in English working in the school including the petitioner but thereafter two more Assistant Teachers in English have joined the school. Now the position is including petitioner there are seven Assistant Teachers in English functioning in the school. Petitioner has made application for transfer on Utsashree portal on 12th August, 2021 which was not forwarded by the aforesaid school authority to the

concerned District Inspector of Schools (S.E.) for processing the transfer application of the petitioner which triggered the present writ petition. Since, excluding the petitioner six Assistant Teachers in English are functioning in the school, this court finds no impediment in directing the said school authority to take steps based on transfer application made by the petitioner on 12th August, 2021.

Hence, authority of Panchagram I.S.A. High School, Murshidabad being respondent nos. 7 & 8 are directed to forward the transfer application of the petitioner in offline mode to the District Inspector of Schools (S.E.), Murshidabad being respondent no.5 by seven (7) days from the date of communication of this order. On receipt of application, respondent no.5 shall process the same and forward the transfer application of the petitioner to the West Bengal Central School Service Commission for taking final decision by fortnight thereafter. The Chairman, West Bengal Central School Service Commission on receipt of transfer application shall decide the same in accordance with law by six (6) weeks thereafter and the decision to be communicated to the petitioner by ten (10) days thereafter.

It is made clear that suspension of Utsashree portal shall not be a ground to reject the transfer application of the petitioner.

With the above directions, writ petition stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
