28.09.2022 sdas rejected C.R.M.(DB) No. 3334 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Bhownipur Police Station Case No. 141 of 2016 dated 27.04.2016 under Sections 120B/201/363/365/366A/370(5)/376/419/420 of the Indian Penal Code and Sections 4/17 of the POCSO Act and Sections 80/81/84 of the Juvenile Justice (Case and Protection of Children) Act.

And In Re : Keshab Das ..... petitioner Mr. Arup Kumar Bhowmick ... for the petitioner Ms. Faria Hossain Mr. Anand Keshari ... for the State Learned Counsel appearing for the petitioner submits he is in custody for more than five years. It is also submitted that the petitioner has been falsely implicated in the instant case. He prays for bail.

Learned Counsel appearing for the State opposes the prayer for bail and submits petitioner was involved in trafficking new born babies. His bail prayer was rejected earlier. Trial is in progress. Next schedule for examination of witnesses is fixed on and from 14th December, 2022.

We have considered the materials on record. Allegations against the petitioner are grave. There are ample evidence connecting the petitioner with trafficking of new born babies. Trial is in progress and next schedule has been fixed for examination of witnesses in December, 2022.

Under such circumstances, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected. Trial court is directed to expedite the trial and conclude the same as expeditiously as possible preferably within one year from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties.
