Mr. Dutta, learned advocate appearing for the petitioner challenges the order dated 19.08.2008 passed by the learned Additional Chief Judicial Magistrate, Katwa in connection with the G. R. Case No. 45 of 2008 arising out of Katwa Police Station No. 28 dated 27.01.2008 under Sections 498A/406 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. As none appears on behalf of the State, Mrs. Ratna Ghosh, learned advocate who ordinarily appears on behalf of the State is directed to represent the State. Her appointment may be regularized by the concerned Authorities in due course. The subject matter of the revisional application relates to the impugned order wherein the learned Additional Chief Judicial Magistrate, Katwa was pleased to reject the prayer of the present petitioner for cancellation of bail granted to the opposite party no.2.

Record of this revisional application reflects that there was a direction for service upon the opposite parties on 15.09.2008 by a co-ordinate Bench of this court but there was no interim order. No information could be furnished before this court regarding the proceedings and its pendency before the learned Magistrate.

Having regard also to the period of time which has lapsed in the meantime, I am of the opinion that the revisional application has become infructous with efflux of time.

Accordingly, the revisional application being CRR 3085 of 2008 is disposed of as infructuous.

Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
