Matter relates to mutual transfer of the petitioner and the respondent no. 10.

Saibal Acharyya, learned advocate representing the petitioner has submitted that offline application dated 26th July, 2024 has been made which requires to be considered by the concerned authority of the West Bengal Central School Service Commission. However, on behalf of the Commission it has been submitted that the application seeking mutual transfer is not in proper form neither requisite fee has been deposited while submitting mutual transfer application. It is also submitted that during suspension of Utsashree Portal authorities would find it difficult to take decision on mutual transfer application.

Having considered the submissions made on behalf of the parties this Court finds that this is not an application for transfer on medical ground requiring immediate consideration. Had it been a case that petitioner or members of her family was suffering from serious ailments question would have been different. This is an application for mutual transfer which has not been made on Portal. The transfer application is not in form and requisite fee has not been deposited. The transfer application was made on 26th July, 2024. In view of aforesaid scenario this Court is not giving direction upon the respondent authorities for taking steps based on such application seeking mutual transfer.

The writ petition stands disposed of.

However, this order shall not preclude the petitioner to apply for mutual transfer in accordance with law in future if situation so arises.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
