Learned advocate appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in connection with the instant case on the basis of statement of co-accused and is detained for one year ten months, only four witnesses out of proposed twelve witnesses have been examined till date. As such, there is no possibility of the trial concluding in near future. The petitioner may be released on bail on any stringent condition.

On the other hand, learned advocate appearing for the State opposes the prayer for bail and submits that the petitioner was found at the house of the accused where 225 KGs of
Ganja recovered. The petitioner could not provide any plausible explanation regarding his presence. 3.
In view of the present stage of the case, I am not inclined to release the petitioner on bail.

As such, the prayer for bail is rejected at this stage. 5.
Accordingly, CRM(NDPS) 1159 of 2025 is dismissed. 6.
It has been informed that the independent witnesses are yet to be examined. Learned Trial Court is directed to conclude the examination of the independent witnesses within a period of 60 days from the next date so fixed. 7.
The petitioner would be at liberty to renew his prayer for bail after completion of the examination of seizure list witnesses.

Case diary be returned to the learned advocate appearing for the State.

All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court.
10. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
