Petitioner is aggrieved by the progress of Hariharpara Police Station Case No. 338/23. It is complained by the petitioner that he suffered a loss to the tune of Rs. 34,83,900/- being deceived by the representations made by the accused persons for installation of tower and in spite of informing the police authorities, no substantial steps have been taken, although FIR has been registered.

Having considered that the case was registered on 08.08.2023 and till date the defacto complainant is unable to know regarding the progress of the investigation, I direct the Investigating Officer to submit a progress report before the jurisdictional Magistrate in seisin of Hariharpar PS Case No. 338/23. The learned

Magistrate would assess regarding the steps taken as also the impediments faced by the Investigating Officer for taking the investigation to its logical conclusion and accordingly fix periodical dates for submission of progress reports so that the investigation can be taken to its conclusion. In case there is dissatisfaction of the learned Magistrate, learned Magistrate would be empowered to direct the Superior Officer in the rank of Additional SP/SDPO to monitor the investigation for securing the ends of justice.

With the aforesaid observations WPA 22518 of 2024 is disposed of.
