Mr. Rajkrishna Mondal Ms. Sunandana Saha ...for the petitioners This application under Article 227 of the Constitution of India is at the instance of the applicant in a revocation proceeding being Miscellaneous Case No.199 of 2015 (revocation) arising out of Miscellaneous Case No.170 of 2010 (probate) pending before the learned Additional District Judge, 7th Court, Barasat.
Learned advocate for the petitioners submits that the Miscellaneous Case is pending from the year 2015 and a direction be passed upon the learned Trial Judge to dispose of the same expeditiously.
In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing the opposite parties before the learned Trial Judge.
This Court finds revocation proceeding is pending for further cross-examination of P.W.1. Learned advocate appearing for the petitioners submits that repeated dates are fixed for crossexamination of P.W.1 and next date for crossexamination of P.W.1 has been fixed on 19th July, 2025.
In the light of the submission made by the learned advocate for the petitioners, CO 3197 of 2024 stands disposed of by requesting the learned Additional District Judge, 7th Court, Barasat to make an endeavour to see that the Miscellaneous Case No.199 of 2015 is disposed of as expeditiously as possible preferably within a period of six months from next date. This order has been passed taking of the fact that the proceedings for revocation of the grant of probate is pending from the year 2015.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
