There is a statement recorded under Section 164 of the Code of Criminal Procedure of the victim implicating the petitioner. The petitioner apparently outraged the modesty of the de facto complainant.

Considering the gravity of the offence and the involvement of the petitioner therein, requirement of custodial interrogation of the petitioner cannot be overlooked.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
