Mr. Debjit Mukherjee Mr. Kaustav Bhattacharya Ms. Priyanka Jana ... for the petitioner After some argument Mr. Mukherjee, learned advocate appearing for the petitioner prays for a direction upon the learned trial judge to dispose of the application under Order 26 Rule 13 of the Code of Civil Procedure expeditiously.

In the light of the said submission, C.O. 3425 of 2025 stands disposed of by giving liberty to the petitioner to pray for preponement of the next date of hearing before the learned trial judge. If such an application is filed, the learned Civil Judge (Senior Division), 3rd Court at Howrah before whom Title Suit No. 126 of 2016 is pending shall consider such application in accordance with law. The learned trial judge is further requested to make an endeavour to dispose of the application under Order 26 Rule 13 of the Code of Civil Procedure as expeditiously as possible but preferably within a period of three months from the next date fixed/to be fixed, without granting any unnecessary adjournments to either of the parties.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
