Affidavit of service filed in Court is taken on record. The petitioner seeks transfer on the ground of distance. The application is pending consideration at the end of the Chairman, District Primary School Council, Malda.

From the report forwarded by the Chairman, District Primary School Council, Malda it appears that the school where the petitioner is teaching has fifty nine students with four teachers including one Head Teacher. The pupil teacher ratio is 1:15.

It appears that there is surplus teacher in the school and there is no bar in considering the application of the petitioner seeking transfer.

In view of the above, the Chairman, District Primary School Council, Malda is directed to consider the prayer of

the petitioner in accordance with law at the earliest but positively within a period of ninety days from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
