The anticipatory bail application of the private respondents/accused was rejected by this Court. They were not arrested. They are roaming around freely. The police have not investigated the case properly. Learned advocate for the State relies on the report and submits as follows. On the complaint of the petitioner, an FIR was registered. Charge-sheet was submitted. A warrant of arrest was issued. The accused surrendered and were granted bail.
Learned advocate for the private respondents submits as follows. The allegations made in the writ petition are denied. Charge-sheet was submitted under lesser charges. They were granted bail upon surrender.
It appears that charge-sheet was submitted lesser sections than under which the FIR was registered. It also appears that the accused thereafter surrendered and were granted bail.
Therefore, no further order need be passed as regards police inaction.
If the petitioner is not satisfied with the investigation, he shall be at liberty to file a protest petition before the learned trial court.
With these observations, the writ petition is disposed of.
