C.R.M. (A) 4659 of 2022 07.11.2022 Sl.20 Court No.29 (AD) (Rejected) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Chanditala Police Station Case No.455 of 2022 dated 08/09/2022 under Sections 498A/306/34 of the Indian Penal Code. And In the matter of: Narugopal Ghosh & Anr.

....petitioners.

Mr. Soumya Basu Roy Chowdhuri ... for the petitioners.

Mr. Rudradipta Nandy, Ld. APP Ms. Sonali Das ... for the State.

Petitioners pray for anticipatory bail.

Learned Advocate appearing for the petitioners submits that the petitioners are the father-in-law and the mother-in-law of the deceased. He submits that the deceased committed suicide. Learned Advocate appearing for the State draws the attention of the Court to the materials in the case diary including the statements of the neighbours recorded under Section 161 of the Code of Criminal Procedure.

There are statements of neighbours alleging that the petitioners tortured the deceased. The incident occurred within one year of marriage.

In such circumstances, we are unable to grant anticipatory bail to the petitioners.

Accordingly, the prayer for anticipatory bail of the petitioners is rejected.

C.R.M. (A) 4659 of 2022 is dismissed.
