Mr. Rudradeb Bagchi ............for the petitioner Ms. Sreemoyee Mitra Mr. Kapil Guha ......for the Bank The petitioner really does not have any cause to come before the writ court. The first alleged grievance is of the respondent -Bank selling the petitioner's bus for approximately Rs. 5 lakhs. The petitioner says that the value at which the bus was sold is incorrect. The second point raised is that the Statement of Accounts relied on by the Bank is incorrect.
Admittedly, the petitioner owes money to the Bank. Whatever may be the amount, the petitioner is not sure of either the quantum of outstanding dues or whether sale of the bus by the Bank to a third party would improve the petitioner's debt position to the Bank.
There is nothing that the Court can do with regard to the sale of the bus. This Court cannot also issue any directions on the Bank as to particularly where the petitioner's outstanding amount is in excess of the amount for which the bus was sold to the third party.
WPA 22270 of 2022 is accordingly dismissed without any order as to costs.
The petitioner will be at liberty to approach the Bank for a one-time settlement. The Bank shall make sure that upon the settlement being reached, original documents are returned to the petitioner including the two LIC Policies which are presently in the custody of the Bank.
