The grievance of the petitioner is that due to resistance put up by the private respondent, who is the husband of the petitioner, the West Bengal State Electricity Distribution Company Ltd. (WBSEDCL) is not being able to give a new electricity connection to the petitioner.

Learned counsel appearing for the WBSEDCL corroborates such stand.

Despite substantial service, the private respondent remains unrepresented when the matter is called on for hearing today.

The petitioner, in view of being an occupant of the premises, is entitled in law to get an independent

electricity connection in her name, provided the other formalities are complied with by her.

Accordingly, WPA No. 22271 of 2022 is allowed, thereby directing the WBSEDCL to give electricity connection in the name of the petitioner as per her application, subject to compliance of all formalities by the petitioner, as expeditiously as possible, preferably within a fortnight from the date of compliance of all formalities and/or the passing of this order, whichever is later.

In the event the WBSEDCL personnel face any obstruction in doing so, it will be open to the said personnel to approach the respondent no.5, the Officer-in-Charge, Bauria Police Station for providing adequate police assistance. If so approached, the respondent no.5 shall give such assistance at the cost of the petitioner by acting on a server copy of this order, without insisting upon prior production of a certified copy thereof.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
