IN THE HIGH COURT AT CALCUTTA

CONSTITUTIONAL WRIT JURISDICTION WPA 21902 of 2025 Maheswar Bouri Vs.

The State of West Bengal & Ors.

Mr. Arpan Guha ... for the Petitioner.

Mr. Kishore Datta, Ld. A.G.

Ms. Sumita Shaw Mr. Soumen Chatterjee ... for the State.

Mr. Nilanjan Bhattacharjee, Sr. Adv. (VC) Mr. Jyoti Prakash Chatterjee Mr. Saikat Dey ... for the University of Burdwan.

Mr. Himadri Sikhar Chakraborty ... for the Respondent No.9.

The petitioner is a student of University of Burdwan; he is challenging the communication bearing No.1216Edn(U)/HED-12011(17)/2/2024-UNV SEC-Dept.

of HE dated September 02, 2025 whereby the Higher Education Department has informed that the Registrar of the said University that the age of superannuation of Sri Sujit Kumar Chowdhury, the Registrar, the respondent no.9 herein has been enhanced from 60 years to 62 years, as such he may continue his service in the post.

It appears that the Department of Higher Education, Government of West Bengal by a notification bearing no. 852-Edu(U)/OM-34L/2018 dated August 30, 2018 has enhanced the age of superannuation of the serving Registrars of the State aided Universities from 60 years to 62 years. Mr. Nilanjan Bhattacharjee, learned senior advocate for the University submits that for the alleged involvement of said Sri Sujit Kumar Chowdhury in the defalcating the fund of the University appropriate steps have already been taken against Sri. Chowdhury.

The Higher Education Department by the impugned communication has only informed that by virtue of the said notification the age of retirement of Sri. Chowdhury has

enhanced from 60 years to 62 years, however the advice that he may continue in service in the post of registrar may not be warranted but the communication is not liable to be interfered with.

WPA 21902 of 2025 is thus dismissed without any order as to costs.

Parties to act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
