WPA 21969 of 2025 (Sima Panja vs. State of West Bengal & Ors.) Mr. Debasish Sur Mr. Rajib Kumar Acharyya Mr. Dipam Mozumder .... For the Petitioner Affidavit of service filed by the petitioner is taken on record.

None appears for the respondents despite service. The petitioner claims to be recorded owner of the plot in question which is recorded as 'jal' in L.R. record of rights. The petitioner alleges that Chaipat Gram Panchayat has constructed a pucca structure in the said land for the purpose of ICDS school without obtaining any sanctioned plan and without conversion of the land. The petitioner submitted a representation before the concerned authority on 28th July, 2025 and seeks consideration of the same.

Upon consideration of the submission made on behalf of the petitioner, this Court directs the Block Development Officer, Daspur II Block, being the 5th respondent herein, to consider and dispose of the representation dated 28th July, 2025 within six weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all

concerned including the petitioner, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. In the event the construction raised by the Panchayat is found to be illegal/unauthorised, the concerned authority shall take necessary steps, in accordance with law.

The application is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
