Mr. Anwar Hossain Ms. Manisha Sharma - For the State Mr. Indranuj Dutta - For the Opposite Party No. 2 This revisional application was preferred challenging the continuance of the Dasnagar Police Station Case No. 34 of 2023 dated 03.04.2023 under Sections 341/195A/324/34 of the Indian Penal Code. During the pendency of the revisional application a compromise was arrived at between the parties. Accordingly by an order dated 14th September, 2023 a report was called for. Today Mr. Hossain, learned advocate appearing for the State submitted a report prepared by the concerned officer of Dasnagar police station which is enclosed along with the statement of Goutam Dey as also his declaration. The said report is kept with the record. Having considered the contents of the report wherein the said Goutam Dey/opposite party No. 2 who has expressed his intention not to pursue the present case which is under

Sections 341/195A/324/34 of the Indian Penal Code, I am of the view that chances of conviction are bleak. Pursuant to the changed circumstances, further proceedings of the Dasnagar Police Station Case No. 34 of 2023 dated 03.04.2023 under Sections 341/195A/324/34 of the Indian Penal Code corresponding to G. R. Case No. 1499 of 2023 pending before the learned Chief Judicial Magistrate, Howrah be hereby quashed.

Accordingly, CRR 3472 of 2023 along with CRAN 1 of 2023 is allowed.

Pending application, if any, stands disposed of. All concerned parties shall act in terms of the copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities. (Tirthankar Ghosh, J.)
