And In Re : Ankit Kumar Yadav @ Dilip @ Lalu ..... petitioner Mr. Sabir Ahmed Md. Abdur Rakib ... for the petitioner Mr. Saibal Bapuli, Ld. APP Mr. Arani Bhattacharyya ... for the State Learned Counsel appearing for the petitioner submits he is in custody for 191 days. It is submitted co-accused Puja Kumari @ Bhaskar has been enlarged on bail.

Learned Counsel appearing for the State opposes prayer for bail.

We have considered materials on record. Electronic evidence i.e. tower locations of the mobile phone of the petitioner and the victim shows that they were in close proximity of one another at the time of occurrence.

In view of the aforesaid incriminating materials on record, we are of the opinion petitioner does not stand on same footing with the co-accused who is enlarged on bail. Date has been fixed for consideration of charge.

Under such circumstances, we are not inclined to grant bail to the petitioner.
