Having perused the documents supplied by the State-respondents with regard to the Election Photo Identity Card (EPIC) of the selected candidate, it appears that the polling Station of the selected candidate is Golashibganj and the name of the selected candidate appears in the voters' list under the part name 'Golashibagnj Free Primary School North'.
The written instruction filed by the Sub-Divisional Officer and Member Convenor of ASHA Selection Committee, Chanchal, Sub-Division, Malda indicates that Golashibganj is under Maharajpur Gram Panchayat of Ratua-II Block. The petitioner and three other candidates
applied for the post of Asha in Golashibganj Primary Health Centre. Sangita Sarkar was the successful candidate. She was appointed. The voter identity card of Sangita Sarkar was verified. Her name was included under Part No.215 of 47-Malatipur Assembly Constituency. Golashibganj Primary Health Centre is situated within the same jurisdiction. She was a resident of Purba Balarampur village under Maharajpur Gram Panchayat. The written instruction is taken on record.
Thus, the allegation of the petitioner that the selected candidate is residing outside the jurisdiction of Golashibganj Primary Health Centre is not substantiated. It also appears from the records that the petitioner and Sangita Sarkar both hail from Purba Balarampur village. Under such circumstances, nothing remains to be decided in the writ petition as the allegations against the selected candidate and against the recruiting authority are not substantiated.
The writ petition is, thus, dismissed.
There shall be no order as to costs.
