The petitioner alleges that the predecessor-ininterest of the private respondent was the landlord of the petitioner and after the death of the mother of the private respondent, the private respondent herein has been constantly harassing and threatening the petitioner by saying that he will evict the petitioner from the suit property and implicate him in false criminal cases. The petitioner claims to have lodged several complaints with the Officer-in-Charge, Ultadanga Police Station.
Learned advocate for the private respondent
submits that the private respondent lodged a complaint with the Officer-in-Charge, Ultadanga Police Station alleging that the petitioner herein is giving shelter to 'Bangladeshi Nationals' and also carrying on illegal acts in the tenanted property. He submits that as a counter blast to the complaint of the private respondent, the petitioner has lodged several complains.
The learned advocate for the petitioner submits that the police authorities are constantly calling upon the petitioner to attend the police station through telephonic calls.
Mr.
Ganguly, learned Additional Government Pleader files a copy of the report of the Inspector-in-Charge, Ultadanga Police Station dated September 10, 2024. He further submits that the petitioner was called for the purpose of making inquiries into the complaint and counter-complaint lodged by the respective parties.
After going through the said report, this Court finds that upon inquiry it was found that there is a dispute between the petitioner and the private respondent with regard to the tenanted premises. The police authorities have asked the parties to maintain peace in the locality and to abide
by law and to approach the appropriate Court for redressal of their grievances.
Therefore, it appears that the police authorities have taken steps on the basis of the complaint lodged by the petitioners. It is open to the petitioner to approach before the proper forum in case the petitioner faces any threat of eviction from the tenanted premises.
With the above observations, the writ petition stands disposed of.
There shall, however, be no order as to costs. (Hiranmay Bhattacharyya, J.)
